Terms of Service

These Terms of Service ("Terms") govern your access to and use of the RecoveredCash.com website and services operated by RecoveredCash LLC ("RecoveredCash," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Our services
RecoveredCash is an independent finder service that searches California unclaimed property records, identifies potential matches with individuals, and assists those individuals in recovering unclaimed funds held by the California State Controller's Office. Our services include:
- Searching California State Controller records for unclaimed property matching your name
- Preparing claim documentation for submission to the California State Controller's Office
- Helping you complete the required California claim form and supporting document package
- Tracking claim status and responding to state requests for additional information
- Providing status updates throughout the claim process
RecoveredCash is not a law firm and does not provide legal advice. We are not affiliated with any government agency.
2. Your right to claim for free
You have the right to search for and file a claim for unclaimed property directly with the California State Controller's Office at no cost. We are required to make this disclosure. The free California claim portal is:

By engaging our services, you acknowledge that you are aware of this right and are choosing to use RecoveredCash for convenience.
3. Fees and payment
Success-only fee
RecoveredCash charges a finder's fee only when California funds are successfully recovered. If we are unable to recover your funds for any reason, you owe us nothing. The fee percentage is disclosed to you before you sign the Finder's Fee Agreement and never exceeds California's statutory cap.
Current fee schedule
For California abandoned-property claims, our fee is 10% of the amount actually recovered - the statutory maximum under Code of Civil Procedure section 1582. The exact fee applicable to your claim is disclosed in your Fee Agreement before you sign. Fees are subject to change for new claims; any fee change does not affect claims already in progress under an executed agreement.
How you are paid
The California State Controller's Office pays you directly - your payment is issued by the State to you, and our fee is paid to us separately by the State. Your money never passes through RecoveredCash.
4. Eligibility
To use our California claim-assistance services you must:
- Be 18 years of age or older
- Be a United States resident
- Be the rightful owner, legal heir, or authorized representative of the unclaimed property
- Provide accurate and complete information during signup and the claims process
- Not have previously filed a claim for the same property through another agent or directly with the state
5. Your obligations
By using our services, you agree to:
- Provide accurate, truthful, and complete information at all times
- Upload only authentic identity documents that belong to you
- Promptly respond to requests for additional information or documentation
- Notify us immediately if you become aware that the property does not belong to you, or if you filed a claim for the same property through another channel
- Not use our services for any fraudulent, illegal, or unauthorized purpose
- Maintain the confidentiality of your account credentials
You are solely responsible for the accuracy of the information you provide. Making false representations in connection with a state unclaimed property claim may constitute fraud and carry criminal penalties.
6. Documents and data
By uploading documents to RecoveredCash, you grant us a limited license to use, process, and transmit those documents solely for the purpose of processing your claim with the applicable state agency. You represent and warrant that you have the right to submit each document you upload.
We store your documents encrypted in secure cloud storage and retain them in accordance with our Privacy Policy and applicable legal requirements. We do not sell or share your documents with any party other than the state agency processing your claim and the service providers listed in our Privacy Policy.
7. Disbursement of funds
The California State Controller's Office issues payment directly to you and pays our fee to us separately. RecoveredCash never receives, holds, or deducts from your recovered California funds.
You are responsible for any taxes owed on recovered funds. RecoveredCash is not a tax advisor and recommends consulting a tax professional regarding the tax treatment of your recovery.
8. Termination
You may close your account at any time by contacting us at hello@recoveredcash.com. Closing your account does not automatically terminate any active Finder's Fee Agreement already executed; that agreement is governed by its own terms.
We reserve the right to suspend or terminate your account if we determine, in our reasonable judgment, that you have violated these Terms, provided false information, or engaged in fraudulent activity. If we terminate your account for cause, we have no further obligation to you except with respect to funds already recovered on your behalf.
9. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT ANY PARTICULAR CLAIM WILL BE APPROVED BY THE STATE, THAT THE AMOUNT RECOVERED WILL MATCH ANY ESTIMATE, OR THAT THE CLAIMS PROCESS WILL BE COMPLETED WITHIN ANY PARTICULAR TIMEFRAME. STATE AGENCIES OPERATE ON THEIR OWN SCHEDULES AND WE HAVE NO CONTROL OVER STATE PROCESSING TIMES.
We make reasonable efforts to identify unclaimed property matches, but we do not represent that every match we present is accurate or that we will identify all unclaimed property that may belong to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECOVEREDCASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE FEES ACTUALLY PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless RecoveredCash and its members, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any information you provide to us that is inaccurate, false, or misleading.
12. Dispute resolution
We encourage you to contact us first at hello@recoveredcash.com if you have a concern — most issues can be resolved quickly.
If a dispute cannot be resolved informally, you agree that it will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. The arbitration will take place in the state where your claim is being processed. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Governing law
These Terms are governed by the laws of the state in which your unclaimed property claim is being processed (the "Claim State"), without regard to its conflict-of-law provisions. For disputes unrelated to a specific claim, the laws of Illinois govern.
14. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the effective date. Your continued use of our services after the effective date constitutes acceptance of the updated Terms. We will not retroactively apply material changes to claims already in progress under executed agreements.
